1. Acceptance of Terms

By accessing or using Portrait123 (the “Service”), you agree to these Terms & Conditions. If you do not agree, do not use the Service.

2. Eligibility and Account Information

You represent that you are legally able to enter into a binding contract. You are responsible for providing accurate information (including email and payment details) and for maintaining the security of your own devices and accounts.

3. Uploaded Content and Rights

You retain ownership of the content you upload. By uploading content, you grant Portrait123 a limited, non-exclusive license to process, transform, store, and deliver that content strictly for operating the Service (including generation, fulfillment, support, and abuse prevention). You confirm that you have all rights and permissions required for uploaded images.

You must not upload unlawful, infringing, abusive, or harmful content. We may remove content or suspend access where reasonably necessary to enforce these Terms or comply with legal obligations.

4. Free Preview Policy

Free preview access is limited and may be restricted by abuse prevention checks (such as email, device fingerprint, IP, VPN, or region rules). Portrait123 may modify or discontinue free preview eligibility at any time.

5. Pricing, Orders, and Payment

Product offerings, prices, discounts, and availability may change without notice. Taxes, duties, and shipping (if applicable) are shown at checkout where possible.

Payments are processed by third-party providers. Portrait123 does not store full payment card numbers.

6. Fulfillment and Delivery

Digital delivery times and print shipping times are estimates, not guarantees. Delays may occur due to queue volume, moderation checks, carrier issues, or external service disruptions.

7. Refunds and Cancellations

Because digital products are delivered electronically and are often personalized, digital purchases are generally non-refundable once delivered, except where required by law.

For physical goods, if an item arrives damaged or materially defective, contact support promptly with order details and photos. We will review and provide an appropriate remedy where applicable.

8. Intellectual Property

The Service, including software, branding, design, and site content (excluding user-uploaded content), is owned by Portrait123 or its licensors and protected by applicable intellectual property laws.

9. Prohibited Use

You agree not to misuse the Service, including by attempting to bypass usage limits, reverse engineer systems, interfere with platform integrity, or engage in fraud or unlawful activity.

10. Disclaimer and Limitation of Liability

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Portrait123 disclaims warranties and is not liable for indirect, incidental, special, consequential, or punitive damages.

To the extent liability cannot be excluded, Portrait123’s total liability will not exceed the amount paid by you for the specific order giving rise to the claim.

11. Changes to Terms

We may update these Terms from time to time. The “Last updated” date reflects the latest revision. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by applicable laws of the jurisdiction in which Portrait123 operates, without regard to conflict of law principles, unless mandatory local law requires otherwise.
